The open and real-time nature of the discussion forums makes it impossible for High Score Society® to vouch for the validity or honesty of posts from individual members. We are not responsible for any messages posted, nor the consequences of reading them. The views expressed in the messages within the forums are those of the authors, who accept total responsibility for the content of their posts. If you find any posts in these forums to be offensive or objectionable, please call our attention to any such post(s) by contacting the website administrator at info@highscoresociety.com. If we determine that removal of a post or posts is necessary, we will make reasonable efforts to do so in a timely manner.

Please follow all directions before you post.  Refrain from using inappropriate language, including language that may look, sound like, stand for, hint at, abbreviate, or insinuate profanity, hate speech (including but not limited to racial, ethnic, or religious slurs), illegal drugs/controlled substances or illegal activities. We welcome all people age thirteen and over of any race, religion, gender, national origin, sexual orientation and point of view but expect all users to refrain from acting in any other way than courteous, reasonable adults.

Our policy herein can best be described as "Be Courteous".  High Score Society ® does not tolerate expressions of bigotry, hatred, harassment or abuse, nor will we tolerate threats of harm to anyone.  Because we encourage open discussion and the free exchange of ideas and opinions, we do not approve of or allow threatening, defamatory, abusive, or illegal statements.  For the same reason, we do not condone sexually explicit material in conversations, room titles, room topics or nicknames.  All terms regulating your use of and postings to the message board in text or word form shall also apply to the posting of any photo or video material whether in the message board area, blog section or any other section of HighScoreSociety.com

We reserve the right to terminate the account of any user who does not fully comply with this policy.  At our sole discretion, termination may be either temporary or final; however, unless we find a compelling reason to re-instate an account violative of our policies, all terminations or account cancellations are final.

Impersonation of other members will be considered a form of harassment, and will not be tolerated. Users may not transmit or encourage others to transmit material or links to material considered patently offensive in nature. This includes, but is not limited to using vulgar, profane, or sexually explicit language; using race, religion, sexual orientation, culture, ethnicity, disability, nationality, or gender as a means of insult; using threatening, harassing, defamatory, hate-speech, or libelous language; and posting, requesting, linking to, or otherwise sharing material considered pornographic, obscene, graphic, or hate speech. Failing to abide by a warning that material or terms are offensive or prohibited is a violation.

Because we cannot actively police all communications occurring between High Score Society® members at all times, we are counting on you to exercise tact and politeness within our chat interface, so please take note of the following terms as they apply to use of the website:

Without limiting altering or voiding any other provision in these Terms, you may not use the website to do any of the following or assist others to do the following:

• Threaten, defame, stalk, abuse, or harass other persons or engage in illegal activities;
• Link from another website or transmit any material in any form that is inappropriate, profane, vulgar, offensive, false, disparaging, defamatory, obscene, illegal, sexually explicit, racist, that promotes violence, racial hatred, or terrorism, or that we deem, in our sole discretion, to be otherwise objectionable;
• Violate any person's or entity's legal rights (including, without limitation, intellectual property, privacy, and publicity rights), transmit material that violates or circumvents such rights, or remove or alter intellectual property or other legal notices;
• Transmit files that contain viruses, spyware, adware, or other harmful code;
• Advertise or promote goods or services without our permission (including, without limitation, by sending spam);
• Interfere with others using the website or otherwise disrupt the website;
• Transmit, collect, or access personally identifiable information about other users without the consent of those users and High Score Society;
• Impersonate any person or entity or otherwise misrepresent your affiliation or the origin of materials you transmit; or
• Defeat any access controls, access any portion of the Services that we have not authorized you to access (including password-protected areas), link to password-protected areas, attempt to access or use another user’s account or information, or allow anyone else to use your account or access credentials.

Additional terms with regard to account registration and maintenance:

    
• You must be at least 13 years old to register for the Service. We do not knowingly collect any information from any users under 13 years of age, and if it is found that an underage user has fraudulently registered, their account will immediately be terminated.
    
• Alteration or modification of any content by any user (including by exploiting any bug or error) is expressly prohibited; this includes exploiting any deficiency in our code or design, or in the code or design of any third party product or service used in connection with the website.

We reserve the right to terminate any account for violation of these use regulations or for any other misuse or prohibited use, where such misuse is not defined within these terms but nevertheless lies in our sole discretion.  

User Submissions

Some features of the site may allow you to submit or transmit audio, video, text, or other materials (collectively, “User Submissions”) to or through the site. When you provide User Submissions, you grant to High Score Society and its parent, subsidiaries, affiliates, and partners a non-exclusive, worldwide, royalty-free, fully sublicenseable license to use, distribute, edit, display, archive, publish, sublicense, perform, reproduce, make available, transmit, broadcast, sell, translate, and create derivative works of those User Submissions, and your name, voice, likeness and other identifying information where part of a User Submission, in any form, media, software, or technology of any kind now known or developed in the future, including, without limitation, for developing, manufacturing, and marketing products. You hereby waive any moral rights you may have in your User Submissions.

We respect your ownership of User Submissions. If you owned a User Submission before providing it to us, you will continue owning it after providing it to us, subject to any rights granted in the Terms and any access granted to others. If you delete a User Submission from the Services, our general license to that User Submission will end after a reasonable period of time required for the deletion to take full effect. However, the User Submission may still exist in our backup copies, which are not publicly available.

If your User Submission is shared with third parties, those third parties may have retained copies of your User Submissions. In addition, if we made use of your User Submission before you deleted it, we will continue to have the right to make, duplicate, redistribute, and sublicense those pre-existing uses, even after you delete the User Submission. Terminating your account on a Service will not automatically delete your User Submissions.

We may refuse or remove a User Submission without notice to you. However, we have no obligation to monitor User Submissions, and you agree that neither we nor our parent, subsidiaries, affiliates, employees, or agents will be liable for User Submissions or any loss or damage resulting from User Submissions.

Except as provided in the Privacy Policy, we do not guarantee that User Submissions will be private, even if the User Submission is in a password-protected area. Accordingly, you should not provide User Submissions that you want protected from others.

By use of this website and by posting, you represent and warrant that you have all rights necessary to grant to High Score Society the license above and that none of your User Submissions are defamatory, violate any rights of third parties (including intellectual property rights or rights of publicity or privacy), or violate applicable law.

The website has been designed to present content in a unique format and appearance. Unless we give you permission, you agree not to access the website using any interface other than ours. We may deny permission to link to the website for any reason in our sole discretion, and you must be able to edit or delete promptly links that you create, upon our request.

User Responsibility; Protection of Your Password; Unauthorized Access

Your membership with High Score Society® is intended for your individual and personal use only. You may not share, license, sub-license, sub-lease, or in any other manner transfer or attempt to transfer or share your membership.  Any activity carried on within your personal account will be attributed to you, and you will be held personally responsible for same.  Do not give any third parties your password or username. 

You are strongly encouraged to select a hard-to-guess password and not re-use that password on any other websites where it may be read by the owners or administrators of that website.  Accessing or attempting to access any user account not belonging to you without permission is prohibited. Accessing another user's account in this manner is grounds for a permanent ban of all accounts from the website.  If you suspect you have received an email fraudulently asking for personal information related to your membership with High Score Society, please contact info@highscoresociety.com at once. 

We reserve the right to immediately terminate or suspend the account of any member who fails to abide by these terms. The decision to suspend or terminate accounts will be made at the sole discretion of the website administrators. All account terminations (bannings) are final.

Multiple Accounts

While it is acceptable for users to maintain multiple accounts, we can and do track all accounts used on the same computer(s) and consider them one account for the purpose of monitoring violations of these Terms of Use. If these Terms of Use are violated severely enough to warrant the termination of one account, all known accounts held by that user and/or all accounts using the same computer(s) may also be banned at the administrators' discretion.

Violations and Penalties

Topics, messages or comments that violate these Terms of Use will be deleted from the boards and additional penalties may be applied at our moderators' discretion. Re-posting deleted violations (yours or those of others) is also considered a violation.

Messages and topics may be removed at any time and for any reason at the sole discretion of our editors and designated moderators. User accounts may be warned, suspended, or revoked at any time and for any reason at the sole discretion of our editors and our designated moderators. All determinations of what is "acceptable" and "unacceptable" content will be determined solely by our editors and moderators.

Intentional, repeated, or severe violations are cause for the banning of your account, all use of the boards from your IP address or your entire ISP. In such event, we also reserve the right to contact your ISP concerning your activities.

No Warranty; Limitation of Liability

High Score society , any software we may provide for the purpose of interacting with the website and all related documentation are being provided to you "as is" and without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the functions contained in the website will meet your requirements.

Further, we do not warrant that the website's service will be uninterrupted, error free or free of viruses or other harmful components. We are not responsible for content posted by our users. No oral or written information or advice given by us or any of our authorized representatives shall create a warranty or in any way increase the scope of this warranty. The above exclusions will not apply in any jurisdiction that does not allow the exclusion of implied warranties.

Additional terms may apply to your use of the website. We will either provide these terms to you or post them on the website; they are incorporated by reference into these terms. If there is a conflict between these terms and any additional terms that apply to a particular aspect or feature of the website, the additional terms will control.

Indemnification

By your use of this website you agree to defend, indemnify, and hold harmless High Score Society and its employees, partners, agents, licensors or other representatives of each of them and all of their successors and assigns with respect to all claims, costs (including attorney’s fees and costs), damages, liabilities, and expenses or obligations of any kind, arising out of or in connection with your use or misuse of the website and its services and features (including, without limitation use of your account, whether or not authorized by you, and claims arising from any other users' submissions or postings).

Governing Law, Venue, and Jurisdiction

These Terms and all claims arising from or related to your use of the Services will be governed by and construed in accordance with the laws of the State of New York, except New York's conflict of law rules.

With respect to any disputes or claims not subject to arbitration (as set forth below), you agree to exclusive jurisdiction in the state and federal courts in New York County, New York State. Notwithstanding any other provision of these terms, we may seek injunctive or other equitable relief from any court of competent jurisdiction.

Regardless of any statute or law to the contrary, you must file any claim or action related to use of the Services or these Terms within one year after such claim or action accrued. Otherwise, you will waive the claim or action.

Arbitration

We may elect to resolve any controversy or claim arising out of or relating to these terms of use y binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Unless we establish a different location, arbitration hearings are to be held in New York, New York. The arbitrator’s award will be binding and may be entered as a judgment in any court of competent jurisdiction.

ORDERING AND PROCESSING TIME

• Online orders are normally processed within 5 BUSINESS DAYS (one week).
• Processing time is SEPARATE from the shipping option that you choose.
• We CANNOT guarantee shipping or delivery time on any order unless it is placed by phone and you let us know when you are trying to receive it by.
• UPS only makes deliveries Monday-Friday, they do not deliver or transport packages on the weekend.
• International orders, US Mail, and orders that require additional credit verification can take longer to process.
• We cannot arrange for pick ups of orders placed with the website.

BILLING ADDRESS + PHONE NUMBER

If you are purchasing equipment or placing a large order, please make sure you give us your correct billing address and your correct billing phone number. For all equipment orders and large orders, we must be able to call that phone number and speak with you or someone else who can verify that you have made a purchase with us. This is our way of avoiding credit card fraud.

We cannot be responsible for shipping delays caused by incorrect information. However if we need additional information, or if there are any discrepancies, you will be contacted within 5 business days from the time the order was placed.

If you need your order by a certain time, please place the order by phone and let us know when you need it.

CHANGES + ADDITIONS TO YOUR ORDER

We cannot guarantee that we will be able to make any changes /additions /cancellations on an order after it is placed. However, if an order has not been sent to the shipping department a change may be possible.

RETURN POLICY

items can be returned within 14 days for store credit only. You will be responsible for shipping charges for exchanges and returns. Returns will be accepted at the discretion of High Score Society.

ITEM AVAILABILITY

If an item you want is unavailable we'll let you know and give you the chance to change or cancel.

If you need an your order by a certain time or you're especially interested in a particular item, the best thing to do is place your order by phone. Just ask and we can check stock for you and make sure that the items you want will be available.

Otherwise, normal processing time of 1-5 business days will apply to all online orders.
